JUMBOmail Terms of Service

Last updated date: 2026-03-23

Welcome to the JUMBOmail website (“JUMBOmail” or “The site” or “The service”).
JUMBOmail provides managed file-sharing services that enable users to access, store, send, receive, share, and sell files via JUMBOmail’s proprietary platform (any of the foregoing the  “Service” or “Services”). The Services include our websites: www.jumbomail.me, and any other subdomains of jumbomail.me, our software plug-ins, tools, and applications, and any other products and services offered by JUMBOmail via the Services. The site is managed and operated by the company Jumbomail Technologies Ltd. (“The Company").

The terms of service apply to all JUMBOmail services encompassing uploading files, sending files, subscription services, database management, JUMBOmail Embedded services, file download, payments, and all other services provided by JUMBOmail.

To make sure we know exactly what to expect from each other, JUMBOmail has written down under which conditions it offers its service. Please read the following terms and conditions carefully (“Terms of Service”) and the JUMBOmail Privacy and Cookies Policy. These Terms of Service constitute a binding legal agreement between you and JUMBOmail, whether you are a Registered User or a visitor browsing the Site. These Terms of Service govern your access to and use of our services and JUMBOmail content.

You acknowledge and agree that by clicking on any “submit”, “send”, “save” or “downloads” buttons, accessing or using the services, or posting any user files from or on the site or through the services, you are indicating that you have read, understand and agree to be bound by these terms of service, whether or not you have registered and created an account with JUMBOmail. If you accept or agree to these Terms of Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms of Service and, in such event, “you” and “your” will refer and apply to that company or other legal entity.

1. The Service

The JUMBOmail website provides a platform for uploading, sending, and transferring files. Service capabilities, including maximum transfer sizes (e.g., up to 1TB total per transfer, subject to plan limits) and maximum single file sizes (e.g., up to 500GB), vary depending on the specific service package or subscription plan selected by the user. Please refer to the descriptions on our service plan pages for current details regarding limits, including plans that may offer capabilities described as ‘unlimited’ subject to fair use policies and specific plan terms.

Classification and Fair Use (Personal vs. Business): JUMBOmail analyzes and monitors system usage patterns to classify the nature of use as "Personal" or "Business". This classification is based, among other things, on the email address type (private domain such as Gmail vs. organizational/custom domain), traffic volumes, the number of users from the same domain, and usage frequency. The Company reserves the right to apply different usage limitations to users classified as "Business" who utilize the free service, including limiting the number of transfers, download volume, or blocking access if the defined quota for free business use is exceeded. In such cases, purchasing a Business Subscription will be required to continue using the Service.

A basic version of the Service, allowing transfers up to a specified limit (e.g., 2GB), may be offered free of charge and without requiring user registration. Registered Users and Subscribers typically have access to enhanced features and higher limits as defined by their account status or subscription plan.

By default, uploaded files are stored on JUMBOmail’s cloud servers for a limited duration (e.g., 3 to 7 days, based on user selection during the transfer process) and are automatically and permanently deleted after this period. Once deleted, files cannot be recovered. Subscribers may have the option, subject to the terms of their specific subscription plan and associated storage limits, to retain files for extended or indefinite periods.

Each transfer initiated via JUMBOmail can be addressed to a specific number of recipient email addresses, with limits varying between free usage and different subscription tiers (e.g., up to 10 recipients for free use, up to 100 for certain subscription plans). Each email notification is dispatched individually to each recipient. Following the successful upload of files by the sender, designated recipients receive an email notification containing instructions and a link for downloading the files.

As part of the Service, users may have the option to utilize the JUMBOpay feature, allowing senders to require payment from recipients prior to file download. This feature is intended to facilitate payment for work product or licensed content. The availability of the JUMBOpay service is subject to geographic restrictions and other conditions determined by JUMBOmail. Additional details regarding the JUMBOpay service, including applicable terms and conditions, can be found at the following link https://www.jumbomail.me/en/jumbo-pay. You can learn more about the JUMBOpay Terms of Service at the following link https://www.jumbomail.me/en/jumbo-pay-terms.

JUMBOmail reserves the right to modify the conditions, features, and limitations of the Services, including maximum file sizes and transfer limits, at any time and at its sole discretion. Any significant changes will typically be communicated as outlined in the “Changes and Updates” section of these Terms.

2. File transfer

JUMBOmail provides the technological platform enabling the transfer of your files. Your use of the Service signifies your understanding and agreement that JUMBOmail provides this platform “AS IS” and is not responsible for any failure of the Service to store, transfer, or delete files, nor for any damage to or loss of information or content contained within the files you transfer. Further details regarding limitations of liability and disclaimers can be found in the “Disclaimer” and “Indemnification and Liability” sections of these Terms.

(a) User Responsibility: As detailed in Section ‘Intellectual Property Rights and Content Ownership‘, you are solely responsible for the files you transfer and warrant that you have the necessary rights to do so.

(b) Limited License: Your use of the Service grants JUMBOmail the limited license required to perform the actions necessary for file transfer, including storage and transmission, potentially utilizing third-party services.

(c) Email Verification: For security purposes and to prevent impersonation, initiating a file transfer may require verification of the sender’s email address. This process typically involves sending a verification code to the provided email address, which the sender must then enter on the JUMBOmail website to authorize and complete the transfer operation.

3. Files download

(a) Access Link Generation: Upon successful completion of a file upload and sharing operation, the Service generates a unique encrypted access link corresponding to the download page for the transferred files. This link is automatically sent via email notification to the recipients designated by the sender during the transfer process.

(b) Link Accessibility and User Responsibility: Access to view and download the files via the download page is technically possible for any individual who possesses the unique access link. As stated in Section 6 (User Responsibility for Link Distribution), you, the sender, are solely responsible for distributing this link only to intended recipients.

(c) Enhanced Security Options (Subscribers): Subscribers may have access to advanced security features, subject to their subscription plan, which can allow for greater control over access to the download page (e.g., password protection). Details of such features are available in the relevant subscription plan descriptions.

(d) Download Tracking: The Service tracks the number of times files are downloaded from a specific link to provide the sender with basic download activity information. Subscribers may have access to more detailed download logs, potentially including timestamps and recipient identifiers (where available), subject to their subscription plan features.

(e) Data Traffic Limits: Access to download files from any single download page link may be subject to data traffic limitations (e.g., a maximum cumulative download volume such as 3 TB). If the cumulative data downloaded via a specific link exceeds the applicable limit, attempts to download further files using that link may be blocked, and users attempting access may receive a notification indicating that the download limit has been reached. JUMBOmail reserves the right to set and modify such traffic limits at its discretion.

4. General Conditions and User Conduct

Your access to and use of the JUMBOmail Services are subject to these Terms of Service, including the conditions and obligations outlined in this section. Failure to comply may result in suspension or termination of your access or account, and removal of content, as detailed elsewhere in these Terms.

4.1 Respect for Rights

You agree to respect the rights of JUMBOmail and third parties. This includes, but is not limited to, intellectual property rights and privacy rights. You may not use the Service to infringe upon any rights, nor to promote, enable, or facilitate such infringement by others.

You represent and warrant that you possess all necessary rights and permissions for any User Content you upload, store, send, or otherwise process using the Services.

(g) Is fraudulent, false, misleading, or deceptive (including phishing attempts);

(h) Contains sensitive information belonging to you or others. Information such as: credit card details, private medical information, government identification numbers, or any other sensitive information;

(i) Contains viruses, malware, Trojan horses, worms, time bombs, spyware, or any other computer code, file, or program designed to interrupt, destroy, limit the functionality of, or gain unauthorized access to computer software, hardware, or telecommunications equipment.

4.4 Prohibited Actions

In addition to the content restrictions above, you agree not to:

(a) Use the Services for any illegal purpose or in violation of any local, state, national, or international law;

(b) Send unsolicited commercial messages (spam) or engage in mass distribution of emails in violation of applicable anti-spam laws or JUMBOmail policies;

(c) Overload, flood, or place unreasonable demands on JUMBOmail’s infrastructure or servers;

(d) Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission, or bypass any measures we may use to prevent or restrict access;

(e) Attempt to probe, scan, or test the vulnerability of the JUMBOmail system or network, or breach any security or authentication measures;

(f) Attempt to access content or accounts not intended for you, or access areas of the Service for which you are not authorized, including attempting to bypass password protection or other security features;

(g) Interfere with or disrupt the Services or servers or networks connected to the Services;

(h) Use the Service in any manner that could damage, disable, overburden, or impair it;

(i) Perform any actions prohibited herein through indirect means or by facilitating such actions by others.

4.5 Service Limitations and Disclaimers

(a) JUMBOmail does not systematically review User Content and is not responsible for it or its effects.

(b) The Service is not intended as a primary file backup service. You are solely responsible for maintaining independent backups of your User Content. JUMBOmail is not liable for the loss or corruption of User Content, and deleted files may not be recoverable.

(c) JUMBOmail is not responsible for harm resulting from exposure to User Content transferred via the Service. You are solely responsible for scanning files you receive for viruses or malware before opening or using them.

(d) JUMBOmail does not guarantee that files will be downloaded by recipients in any specific order. If order is important, you should manage file naming conventions or provide separate instructions to recipients.

(e) JUMBOmail is not responsible for variations in upload or download speeds, which can be affected by numerous factors beyond JUMBOmail’s control. More information on upload speed can be found on the page  Upload speed test.

(f) While JUMBOmail strives to provide a reliable service, it does not guarantee error-free or uninterrupted operation. Malfunctions may occur, and JUMBOmail is not liable for failures in file transfer or download operations.

(g) User Responsibility for Verifying Transfer Integrity: Both the user initiating the transfer (the "Sender") and the user receiving the files (the "Recipient") bear the sole responsibility for verifying the completeness and accuracy of every file transfer. Sender's Responsibility: The Sender must monitor the file upload process and confirm that all intended files were successfully sent. The Sender is obligated to pay attention to any system notifications appearing during or after the upload process, including notifications of errors or partial uploads, and to act accordingly. Recipient's Responsibility: The Recipient (including subscribers using automated download features such as JUMBOforms FTP) has the sole responsibility to check and verify that the received set of files is complete, correct, and accurate before any commercial, production, or other use of the files (such as printing, distribution, etc.). JUMBOmail shall not be liable for any damage, loss, cost, or harm of any kind resulting from the use of a partial or incorrect set of files, even if the discrepancy resulted from a technical fault or a partial failure in the upload or download process. The final responsibility for quality control and for ensuring the integrity of the transferred content rests exclusively with the users (both Sender and Recipient).

(h) JUMBOmail reserves the right to log user IP addresses for system monitoring, security, and abuse prevention purposes, in accordance with our Privacy Policy.

The Service may contain links to third-party websites or resources. JUMBOmail provides these links only as a convenience and is not responsible for the content, products, services, or availability of such external sites or resources. The inclusion of links does not imply endorsement. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.

4.7 Enforcement Rights

JUMBOmail reserves the right, at its sole discretion and without prior notice, to investigate violations of these Terms and to take appropriate action, including but not limited to:

(a) Removing or disabling access to any User Content deemed to be in violation of these Terms or applicable law, or otherwise harmful or objectionable;

(b) Suspending or terminating your account or access to the Services;

(c) Blocking access from specific IP addresses;

(d) Reporting suspected illegal activities to law enforcement authorities.

4.8 Privacy Policy Agreement

By using the Service, you acknowledge and agree to the terms of the JUMBOmail Privacy Policy, which is incorporated herein by reference.

5. Data Deletion Policies

This section outlines JUMBOmail’s policies regarding the deletion of files and associated transfer records. Users should note that  the Service is not a backup service, and maintaining independent copies of important files is the user’s sole responsibility.

5.1 Default File Deletion (Completed Transfers)

Each file transfer operation (referred to as a “Delivery” or “Project”) involves the temporary storage of associated User Content. Unless extended retention options are selected by the sender or an authorized user (typically available to Subscribers under their plan terms), files associated with a completed delivery are automatically and permanently deleted from JUMBOmail’s storage systems after a default period (e.g., 3 to 7 days from the delivery creation date, based on settings chosen during transfer). Once deleted, these files cannot be recovered.

Files of users using the free service, or file transfers made by Subscribers that were not set for retention beyond the default availability period (3-7 days), are automatically deleted immediately upon the expiration of the availability period. The deletion of files from the Company's systems is performed automatically, immediately, and permanently, and they cannot be recovered.

Regarding files of Subscribers that were set for retention beyond the default period: in the event of the expiration of the defined retention period, or upon termination or cancellation of the subscription (including due to payment renewal failure), the files will become Inaccessible. However, solely to protect against technical billing failures and prevent unintended data loss due to erroneous deletion, such files may be retained in an internal, secure backup archive (Cold Storage) for an additional period of up to 30 days ("Grace Period"). At the end of this period, the files will be permanently deleted without the possibility of recovery. It is hereby clarified that this temporary archiving serves the Company's internal operational and backup needs only, and does not constitute a commitment to provide a data recovery service for the user. The Company does not guarantee the ability to restore expired files.

5.2 Deletion of Failed/Incomplete Transfers

Deliveries where the file upload process was not successfully completed (e.g., due to user abandonment or technical interruption), referred to as “failed deliveries,” are subject to accelerated deletion. Any files partially or fully uploaded as part of a failed delivery are automatically and permanently deleted (e.g., after 48 hours from the failed delivery’s creation time). These files also cannot be recovered.

5.3 Deletion of Historical Transfer Records

To maintain system performance, JUMBOmail periodically removes historical metadata records associated with past deliveries. This record deletion may apply to:

(a) Records associated with non-registered user activity older than a specified period (e.g., one year).

(b) Records associated with registered users utilizing the free service tier older than a specified period (e.g., three years).

(c) Records proactively deleted by Subscribers from their account management interface.

The deletion of these records means that historical documentation and information regarding the specific transfer event (e.g., sender, recipient, timestamp, file names for that transfer) will no longer be available through the Service.

5.4 No Liability for Deletion

You acknowledge and agree that JUMBOmail is not liable for any loss or damage arising from the deletion of files or historical records in accordance with these policies. Users will have no claim or complaint against JUMBOmail concerning the permanent deletion of files or the removal of historical transfer records as described herein.

6. Confidentiality and Security of User Content

Commitment to Confidentiality: JumboMail is committed to maintaining the confidentiality of the files and associated messages (“User Content”) you transfer using our Service. Transfers facilitated between you (the sender) and your designated recipients are treated by JumboMail with strict confidentiality.

No General Monitoring or Access: JumboMail does not, as a standard practice, monitor, access, inspect, open, or disclose the specific content of files or messages transferred via the Service. Our systems are designed to facilitate the transfer of User Content without requiring analysis or review of the substance of the content itself.

Limited Access Rights: JumboMail reserves the right to access or review User Content only under specific, limited circumstances and strictly to the extent necessary:

(a) To provide technical support services explicitly requested by you, the user;

(b) To investigate potential violations of these Terms of Use or applicable laws;

(c) To comply with valid legal processes, governmental requests, or court orders;

(d) To ensure the security and integrity of the Service and protect the rights and safety of JumboMail, its users, or the public;

(e) As otherwise described and permitted within our comprehensive Privacy and Cookie Policy.

Any such access will be conducted in accordance with applicable laws and our Privacy and Cookie Statement.

Prevention of Unintended Discovery: JumboMail does not index User Content in a manner that makes it discoverable by public search engines. Furthermore, the Service does not offer features that allow users, other than the sender and intended recipients, to search, catalog, list, or otherwise discover User Content transferred or uploaded by others through the public-facing aspects of the site.

User Account Management Interface: Registered Users and Subscribers are provided access to an internal management interface within their account. This interface allows users to view, track, and manage only those transfers they have initiated (sent) or those specifically addressed to them (received). This management functionality is considered an integral component of the Service provided to account holders.

User Responsibility for Link Distribution: You, the user, bear sole responsibility for the secure and appropriate distribution of any download links generated through the Service. It is imperative that you share these links only with the individuals or entities you intend to receive the User Content.

Access via Download Link: Be advised that any individual who possesses or is forwarded a download link will be technically able to access and download the corresponding User Content hosted on the download page, unless that page is secured by additional measures, such as password protection.

Enhanced Security Features for Subscribers: Certain subscription plans may offer enhanced security options, including, but not limited to, the ability to apply password protection to download pages. Availability and specifics of such features are detailed in the descriptions of the respective subscription plans. Users are encouraged to utilize these features where appropriate to enhance the security of their shared User Content.

Confidentiality in Business Accounts: JUMBOmail's commitment to confidentiality as detailed in this section applies to the Business Account as a whole in relation to external third parties. However, this commitment does not apply to the internal access to information among users within the same Business Account, which is subject to the permissions and policies set by the Primary Account Administrator, as detailed in Section 13.

7. Intellectual Property Rights and Content Ownership

7.1 User Content and Limited License Grant

(a) Ownership of User Content: When utilizing the Services provided on the JumboMail website, you may provide, upload, send, or store data including files, content, messages, recipient contact information, and similar materials (collectively, “User Content”). You retain full ownership of and all pre-existing rights to your User Content. These Terms of Service do not grant JumboMail any ownership rights in your User Content.

(b) Limited License to JumboMail: In order to operate, provide, maintain, and improve the Services, we require certain permissions from you. By using the Services, you grant JumboMail a limited, worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, modify (e.g., to create previews or adapt content for display), transmit, distribute, and publicly display (only when explicitly directed by you, e.g., sharing) your User Content. This license is granted solely for the purpose of enabling JumboMail to provide and enhance the Services,  including performing necessary actions like storing, backing up, and transmitting your data at your request, as described herein and in our Privacy Policy.

(c) Responsibility for User Content: You are solely and fully responsible for your User Content, including its legality, reliability, accuracy, and appropriateness, and for all consequences arising from storing, transmitting, sharing, or otherwise making your User Content available via the Services.

(d) User Representations and Warranties Regarding Content: You represent and warrant that: (i) you own or have secured all necessary rights, licenses, consents, permissions, and authorities, including without limitation copyright and other intellectual property rights, required to submit, store, transfer, distribute, and otherwise use your User Content in connection with the Services; and (ii) your User Content and its use through the Services does not and will not violate these Terms, any applicable law or regulation, or infringe upon or misappropriate the intellectual property, privacy, publicity, or other rights of any third party.

(e) System Access for Features: The Services include features such as media content previews, document viewing, annotation capabilities, sharing functions, and search functionalities. Provision of these and other features may necessitate access, storage, and automated scanning of your User Content by our systems. Your use of the Services constitutes your consent for JumboMail to perform these actions.

(f) Sublicensing to Service Providers: The limited license you grant to JumboMail in Section 7.1(b) also extends to trusted third-party partners and service providers (such as hosting providers and infrastructure partners) with whom we work, solely to the extent necessary for them to assist us in providing and improving the Services, and under obligations consistent with these Terms and our Privacy Policy.

7.2 JUMBOmail’s Proprietary Rights

(a) Ownership of Services and JumboMail Content: Excluding User Content, all rights, title, and interest in and to the Services and any materials displayed or made available through the Services, including but not limited to software, text, graphics, logos, photographs, audio, video, documents, information, and overall design and appearance (collectively, “JumboMail Content”), are and will remain the exclusive property of JumboMail and its licensors. The Services and JumboMail Content are protected by copyright, trademark, and other applicable intellectual property laws. All rights not expressly granted herein are reserved by JumboMail.

(b) Restrictions on Use: You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services or JumboMail Content. Except as expressly permitted within these Terms of Service, you may not reproduce, modify, adapt, distribute, sell, transfer, publicly display, transmit, broadcast, or create derivative works based upon the Services or JumboMail Content.

(c) No Implied Licenses: You are granted no licenses or rights by implication or otherwise in or to any intellectual property owned or controlled by JumboMail or its licensors, except for the licenses and rights expressly granted in these Terms of Service.

7.3 Trademarks

The name “JumboMail,” the JumboMail logo, and all related trademarks, service marks, product names, and trade names appearing on the Services are trademarks owned by JumboMail (“JumboMail Marks”). All other trademarks, service marks, product names, company names, and logos appearing on the Services are the property of their respective owners (“Third-Party Marks”). You may not use or display any JumboMail Marks or Third-Party Marks without the prior written consent of the respective owner.

7.4 Content Responsibility and Removal Rights

(a) Disclaimer of Content Review: JumboMail does not systematically monitor or review User Content transmitted through the Service. You acknowledge and agree that JumboMail is not responsible or liable for any User Content transmitted or processed through the Service by you or any third party.

(b) Right to Remove Content: While under no obligation to do so, JumboMail reserves the right, in its sole discretion, to remove or disable access to any User Content that it deems to be in violation of these Terms of Service, applicable law, or otherwise harmful or objectionable.

JUMBOmail respects the intellectual property rights of others and expects its users to do the same.

It is our policy to respond to notices of alleged copyright infringement that comply with applicable intellectual property law, including the Digital Millennium Copyright Act (DMCA) or equivalent legislation in relevant jurisdictions. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify JUMBOmail’s copyright agent by using the ‘Report This Page’ form, as can be found under the info panel on the download page of the infringing content.

We reserve the right, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who are determined to be repeat infringers, and to remove or disable access to content claimed to be copyright-infringing.

9. Registration and User Accounts

Account Requirement: Access to certain features and functionalities of the Service may require you to register and create a JUMBOmail user account ("User Account"). It is clarified that sending files via the Service, which requires verification of the sender's email address, constitutes in itself a registration action and the creation of a basic registered User Account in the system for that email address, and details related to this action will be stored in your account accordingly. Upon successful completion of registration, you become a "Registered User".

Eligibility for Purchases Only Registered Users who are 18 years of age or older are permitted to purchase paid subscription services (“Premium Services”) as detailed in the “Payments for Services” section. By purchasing Premium Services, you represent and warrant that you meet this age requirement.

Registration Information: During the registration process, you will be required to provide certain information (such as name and email address) and create a password for your User Account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy. JUMBOmail is not responsible for any issues, including non-delivery of communications, arising from inaccurate or incomplete information provided by you.

Account Verification: By creating a User Account, you authorize JUMBOmail, directly or through third parties, to make any inquiries we consider necessary or appropriate to verify your identity and the information you provide. This may involve sharing your information with such third parties for verification purposes, subject to our Privacy Policy.

Account Suspension/Termination (Inaccurate Information): JUMBOmail reserves the right to suspend or terminate your User Account if any information provided during registration or thereafter is found to be inaccurate, outdated, or incomplete.

Password Security: Your account password is encrypted and not directly accessible by JUMBOmail personnel. You are solely responsible for safeguarding your password and keeping it confidential. Do not disclose your password to any third party. You agree to take sole responsibility for any activities or actions under your User Account, whether or not you have authorized such activities or actions.

Unauthorized Use Notification: You must immediately notify JUMBOmail of any suspected or actual unauthorized use of your User Account or password. Upon becoming aware of such unauthorized use, you should also promptly update your account information and change your password.

10. Abuse and Spam Policy

JUMBOmail is committed to preventing the misuse of its Services for abusive purposes, including harassment and the distribution of unsolicited commercial messages (spam).

10.1. Prohibition of Abuse and Harassment: You are strictly prohibited from using the Services to engage in activities that constitute abuse or harassment towards other JUMBOmail users or any third party. This includes, but is not limited to, sending harassing messages or utilizing multiple accounts to circumvent restrictions or target individuals. Such activities are considered a violation of the user conduct rules.

10.2. Single Account Policy: To prevent fraud and abuse, users are limited to maintaining one active User Account. Creating multiple accounts for purposes such as circumventing service limitations, violating these Terms, engaging in spamming activities, or harassing others is strictly prohibited. JUMBOmail reserves the right, at its sole discretion, to disable or terminate any additional accounts created in violation of this policy, and may suspend or terminate all associated accounts.

10.3. User Responsibility and Caution Against Online Fraud (Phishing): We are aware that malicious actors on the internet may attempt to misuse our platform or impersonate JUMBOmail services in order to steal personal information or distribute malware. You must exercise discretion and caution when opening links or downloading files:

(a) Identify the Sender and Website Address: Always ensure that you know the sender and are expecting to receive files from them. Official messages on behalf of our system are always sent from the address no-reply@jumbomail.me. A message sent from another address claiming to be a system message from JUMBOmail is suspicious and should be treated as such. Additionally, before entering any details or clicking on a link to download files, verify that the website address in the browser (URL) is jumbomail.me and that a secure connection exists (padlock icon).

(b) Avoid Providing Passwords for External Services: JUMBOmail will never ask you for the password to your private or organizational email account (such as Gmail, Microsoft, Yahoo, etc.) to allow you to download or view files. Any page requiring you to enter your private email account password to download a file from JUMBOmail is a phishing scam, and you must not enter any details.

(c) Scanning Files: The sole responsibility for scanning files downloaded from the platform for viruses or malware prior to opening them on your computer rests with you.

(d) Reporting: If you encounter a phishing file hosted on JUMBOmail or an email impersonating us, please report it immediately to support@jumbomail.me or through the reporting mechanism on the download page. We will investigate the report and block the offending account immediately.

(e) Disclaimer of Liability: It is clarified that in accordance with Sections 24 and 25 of these Terms, JUMBOmail shall not bear any liability for any damage, direct or indirect, caused to you or anyone on your behalf as a result of opening malicious links, downloading malware/ransomware files, or exposure to online fraud and phishing attempts, even if these were carried out using our platform or by impersonating it.

10.4. Spam Filtering and Enforcement: (a) Monitoring: JUMBOmail employs monitoring tools and techniques intended to detect and filter emails or file transfers suspected of being spam or violating these Terms. (b) Blocking: Transfers identified as suspected spam may be automatically blocked and not delivered to the intended recipient(s). (c) Review Request: If you believe a legitimate transfer initiated by you has been incorrectly blocked as spam, you may contact JUMBOmail support to request a review. If JUMBOmail determines, in its discretion, that the transfer was blocked in error, efforts may be made to release it. (d) Right to Block Repeat Offenders: JUMBOmail reserves the right, without prior notice and at its sole discretion, to permanently block users or specific IP addresses identified as sources of repeated spam or abusive activity. Users blocked under this provision will have no claim or complaint against JUMBOmail regarding such blocking.

10.5. Reporting Abuse: If you receive an unsolicited or abusive message that appears to originate from or be transmitted via the JUMBOmail Service, please report it by forwarding a copy of the message along with any relevant details to abuse@jumbomail.me or use the contact support form.

11. Payments and Purchases

This section outlines the terms governing payments made for Services offered on the JUMBOmail website.

11.1 Eligibility to Purchase

Purchases of Premium Services or other paid features on the site are permitted only for Registered Users who meet the age requirements (18 years or older) and who possess the legal authority to use the chosen payment method.

11.2 Billing Information

When making a purchase, you will be required to provide accurate and current billing information, which may include your name, billing address, email address, and details for your chosen payment method (“ Payment Method”). You authorize JUMBOmail and its payment processors to use this information to process your payment(s).

11.3 Payment Processing

(a) Direct Credit Card Payments: For payments made directly via credit card, JUMBOmail utilizes third-party payment processors. While you provide your details through our interface, JUMBOmail does not store your full credit card number. Payment processing is handled directly by the secure systems of our payment processor(s), subject to their terms and privacy policies.

(b) External Service Providers (e.g., PayPal): If you choose to pay using an external service provider like PayPal, the transaction is processed according to that provider’s terms, conditions, and privacy policy. JUMBOmail is not responsible for the operations, security, or fee policies of such external providers. Any issues or claims related to transactions processed by an external provider should be directed to that provider.

11.4 User Representations and Authorizations

By initiating a transaction, you represent and warrant that:

(a) You are legally authorized to use the selected Payment Method (e.g., the credit card or external provider account belongs to you or the entity you represent);

(b) The Payment Method is valid and has sufficient funds or credit available to complete the transaction;

(c) You are authorized under applicable law and any relevant agreements (e.g., with your card issuer) to make the purchase for the specified amount;

(d) All billing information provided by you is accurate, complete, and current;

(e) If making a purchase on behalf of a corporation or other legal entity, you have the legal authority to bind that entity to the transaction.

11.5 Invoicing and Communication

JUMBOmail will provide invoices related to your purchases, typically made available electronically through the payments page on your User Account management interface. By registering for and using paid Services, you consent to receive invoices, payment confirmations, and other legally required payment-related communications electronically at the email address associated with your User Account.

11.6 Taxes

You are responsible for paying any applicable taxes (such as VAT, sales tax, etc.) associated with your purchases, unless otherwise explicitly stated by JUMBOmail. Prices displayed may or may not include applicable taxes; the final amount charged will reflect the price plus any required taxes based on your billing information and applicable law.

12. Subscription Services

12.1 Definition and Scope

Access to and use of certain enhanced features, higher limits, or specific functionalities of the Service (“Premium Services” or “Subscription Services”) require a paid subscription. Available Subscription Services may include capabilities such as increased file transfer limits (e.g., up to 1TB per transfer, subject to plan terms), expanded cloud storage allowances for retained files, personal branding options, and other features as described in the specific subscription plan details. JUMBOmail reserves the right to modify the features and scope of any Subscription Service plan from time to time at its discretion.

12.2 Subscription Term and Billing Cycles

Unless otherwise specified during the purchase process, subscriptions are offered on a recurring basis. JUMBOmail typically offers different payment routes, such as  monthly and annual subscription options. The period covered by each payment constitutes the “Subscription Term,” and payments are charged according to the corresponding monthly or annual billing cycle (“Billing Cycle”). Annual subscriptions may be offered at a discounted rate compared to monthly subscriptions (e.g., prepayment discounts). Details regarding the specific term, billing frequency, and available payment routes will be presented at the time of purchase.

12.3 Agreement to Pay and Authorization

By purchasing a Subscription Service, you agree to pay the applicable subscription fees (“Subscription Fees”) as presented at the time of purchase, plus any relevant taxes or other charges associated with your use of the selected Services. Your purchase constitutes a binding service agreement between you and JUMBOmail for the selected Subscription Service and Subscription Term. You expressly authorize JUMBOmail (or its third-party payment processor) to charge your designated Payment Method on a recurring basis according to your selected Billing Cycle for the duration of your subscription, using the payment provider you select (e.g., credit card, external providers like PayPal).

12.4 Subscription Fees and Price Changes

Subscription Fees are specified on the JUMBOmail website, typically detailed on a dedicated Subscription Services price list page, or at the point of purchase. JUMBOmail reserves the right to change the Subscription Fees, package names, characteristics, or the structure of its subscription plans from time to time, at its sole discretion. Any changes to fees for existing subscriptions will be communicated to subscribers in advance, typically via email to the address associated with the User Account, providing reasonable notice before the changes take effect (often at the start of the next Billing Cycle).

12.5 Automatic Renewal

(a) Renewal Mechanism: Unless you explicitly disable the automatic renewal setting, your Subscription Service will automatically renew at the end of each Subscription Term for a subsequent term of the same duration (e.g., month-to-month or year-to-year). Billing for the renewal term will occur automatically on or around the calendar day corresponding to the start date of your initial subscription, using the Payment Method associated with your account.

(b) Disabling Auto-Renewal: You can disable the automatic renewal setting at any time through your User Account management interface or by contacting JUMBOmail support as outlined in the Termination section. Disabling auto-renewal prior to the renewal date will prevent future charges, and your subscription will remain active until the end of the current paid term. It will then expire, and you will need to manually purchase a new subscription if you wish to continue using the Premium Services.

(c) User Responsibility (Payment Details & Monitoring): You are responsible for ensuring your Payment Method details and associated User Account information (including email address) remain accurate and up-to-date. Failure to maintain valid payment information may result in failed renewal attempts. JUMBOmail is not responsible for subscription cancellations resulting from your failure to receive email notifications (e.g., due to incorrect email address, spam filters, or technical issues). It is your responsibility to monitor your subscription status and renewal dates.

(d) Failed Renewal Attempts: If a recurring payment attempt fails (e.g., due to an expired card or insufficient funds), JUMBOmail may attempt to process the payment again. You may receive email notifications regarding failed payment attempts. If recurring payment attempts fail repeatedly (e.g., after 5 attempts), your subscription may be automatically cancelled.

(e) Non-Renewing Subscriptions: If your subscription is explicitly designated as non-renewing, JUMBOmail may send reminder notifications to your registered email address as the expiration date approaches, prompting you to manually renew if desired.

12.6 Subscription Add-ons and Extensions

Active subscribers may have the option to purchase add-ons or extensions to their base Subscription Service (“Add-ons”). Availability of specific Add-ons may depend on the base subscription plan.

(a) Storage Volume Add-ons: Subscribers may be able to increase or decrease their storage volume in defined increments (e.g., 1TB blocks) at a specified fixed price per increment.

(b) Sub-Account Licenses: Subscribers on eligible plans may purchase licenses to manage multiple users under a single Business Account. These sub-accounts typically share the benefits and storage pool of the primary subscription. The number of licenses can often be increased or decreased, with a fixed price per additional license. The full terms, permission levels, and privacy implications related to the management of Sub-Accounts are detailed in Section 13: 'Business Accounts and User Management'.

Billing for Add-ons: (i) Add-ons are typically purchased under a separate, renewable monthly service contract, regardless of the base subscription’s term (monthly or annual). (ii) If you have a monthly base subscription, the initial charge for a newly purchased Add-on may be prorated based on the number of days remaining in your current base subscription Billing Cycle. Subsequently, the Add-on fee will be added to your base subscription fee and charged monthly. (iii) If you have an annual base subscription, purchasing an Add-on creates an additional monthly billing cycle specifically for that Add-on, charged separately from your annual base subscription fee.

12.7 Changing Subscription Plans and Add-ons

(a) Modification: You may be able to change your base Subscription Service plan or modify your active Add-ons (e.g., increase/decrease storage or sub-account licenses) at any time through your User Account management interface, subject to availability and plan restrictions.

(b) Effective Date: Changes typically take effect immediately upon confirmation of the change process.

(c) Billing Adjustments (Upgrades): When upgrading your base subscription plan, the initial payment for the upgraded plan may be calculated proportionally based on the time remaining in your current Billing Cycle. Subsequent charges at the start of the next Billing Cycle will reflect the full price of the upgraded plan. Similar prorated charges may apply when adding or increasing Add-ons mid-cycle.

(d) Billing Adjustments (Downgrades): When downgrading your base subscription plan or reducing/removing Add-ons, the change in the recurring charge will typically take effect starting from the  next Billing Cycle. No refunds or credits are generally provided for partial Billing Cycles remaining on the higher-tier plan or Add-on.

(e) Downgrade Conditions: Downgrading your plan or reducing Add-ons may be contingent upon your current usage (e.g., stored data volume, number of active sub-accounts) being within the limits of the new, lower-tier plan or reduced Add-on configuration. You may need to reduce your usage (e.g., delete files, remove sub-accounts) before a downgrade can be processed.

12.8 Service Limitations

(a) Storage Limits: Subscription Services may include a specific allocation of cloud storage space. Files saved by a subscriber count towards this limit. Attempting to save files exceeding the allocated storage volume may fail until sufficient space is made available by deleting existing files or upgrading the storage allocation (if available).

(b) Not a Backup Service: As stated in the General Conditions section, the storage provided as part of any Subscription Service is not intended as a primary or archival backup solution. JUMBOmail is not liable for data loss due to technical failures or other reasons, and users are responsible for maintaining their own independent backups.

(c) Data Deletion upon Cancellation/Expiration: In the event your subscription is cancelled (either by you or due to non-payment/failed renewal) or expires without renewal, access to Premium Services will cease. Furthermore, User Content and associated data stored under the subscription (beyond any standard free tier allowances or retention periods) may be permanently deleted in accordance with JUMBOmail’s data deletion policies. You will have no claim against JUMBOmail regarding such data deletion.

12.9 Refunds and Cancellations

Subscription Fees are generally non-refundable, except as expressly stated in the “Termination of Subscription and Cancellation of a Transaction” section or as required by applicable law. Cancellation procedures and any applicable conditions, potential fees, or refund calculations (including adjustments for promotional periods or usage) are detailed in the aforementioned Termination section.

12.10 Discontinued Purchase Options (Pay-As-You-Go)

Please note that certain past purchase options, such as the ability to buy individual upload codes on a pay-as-you-go basis, are no longer offered or supported by JUMBOmail. Current service access requires an active free account or a valid Subscription Service plan.

13. Business Accounts and User Management

13.1 General

Subscribers on Business or Enterprise plans ("Business Account") may purchase licenses for multiple end-users ("Sub-Accounts") under one primary account. The user who creates the Business Account or is designated as such will be defined as the "Primary Account Administrator".

13.2 License Management and Billing

The Primary Account Administrator can add or remove Sub-Account licenses through the management interface. Each active license will be billed at a fixed monthly rate, as detailed in the service price list, which will be added to the base subscription fee of the Business Account.

13.3 Permission Levels

Within a Business Account, three permission levels can be set:
User: Basic permission to use the Premium Services of the account.
Supervisor: In addition to User permissions, can view and manage content and transfers of other users within the same Business Account.
Manager: In addition to Supervisor permissions, can also add, remove, and manage the settings of other users in the Business Account.

13.4 Privacy Notice and Content Access in a Business Account

This section serves as an important notice to all users of Sub-Accounts within a Business Account.
By joining or accepting an invitation to a Business Account, you acknowledge, understand, and agree that your User Content, including all files and messages you send or receive through the Service, is not private in relation to that Business Account.
The Primary Account Administrator, as well as any user assigned 'Supervisor' or 'Manager' permissions within that Business Account, may access, view, monitor, use, modify, export, and disclose all of your User Content and activity associated with your account.

JUMBOmail is not responsible for the internal management of or access to information within a Business Account; this responsibility, including notifying employees and obtaining their consent, rests exclusively with the Primary Account Administrator and the respective organization. For further details on how data is handled in Business Accounts, please refer to our Privacy Policy.

13.5 Use of an Organizational Email Address and Joining a Business Account

If you registered for the JUMBOmail service using an email address provided to you by an organization (such as your employer, educational institution, etc.), your organization may contact us with the goal of setting up a business account or managing existing licenses.

In such a case, and upon an explicit request in writtin from authorized representatives of your organization, we may share with the organization the mere fact that your organizational email address is registered with the service, as well as statistical and aggregated data regarding the volume of use performed under that organizational domain (such as total traffic volume or the number of transfers performed).

The sole purpose of sharing this information is to allow the organization to map its licensing needs and identify existing users for their possible inclusion in the business account. We will share this information only after we have reasonably verified the identity and authority of the organization's representatives to receive this information.

It is clarified and emphasized that this disclosure is limited to aggregated usage volume data and confirmation of account existence only. Under no circumstances, as long as you have not been formally joined to the organizational account (subject to the terms of Section 13.4 above), will we disclose to your organization information regarding the content of the files you transferred, file names, or specific metadata details of individual deliveries.

14. Termination of subscription and cancellation of a transaction

This section outlines the procedures and consequences related to the cancellation of Subscription Services and the deletion of your User Account.

14.1 Methods of Cancellation

You may choose to cancel your recurring Subscription Service or request deletion of your User Account at any time, subject to these Terms and applicable law. You can initiate cancellation or account deletion through one of the following methods: (a) Account Interface: Utilizing the cancellation or account deletion options available within your User Account management interface on the JUMBOmail website. (b)  Support Form: Submitting a request through the official Contact Form on the JUMBOmail website. (c) Email: Sending a cancellation or deletion request via email to support@jumbomail.me. (d) Phone: Contacting customer support via phone number displayed on the contact us page.

14.2 Effect of Subscription Cancellation (Not Account Deletion)

It is important to distinguish between the action of disabling auto-renewal and the action of immediate subscription cancellation.

Disabling Auto-Renewal: This action, described in Section 12.5(b), prevents future charges but allows you to continue using the Premium Services until the end of the current, already paid Subscription Term.

Immediate Subscription Cancellation: This action terminates the subscription and access to Premium Services immediately, as detailed below.

(a) Stopping Future Charges: Both immediate cancellation and disabling auto-renewal will prevent future recurring charges for that Subscription Service.

(b) Access to Service: In the case of disabling auto-renewal, your access to the relevant Premium Services will continue until the end of the current, already paid Subscription Term. In the case of immediate subscription cancellation, your access to Premium Services (such as personal branding, file uploads exceeding 2GB, and other features available only to active subscribers) will be blocked immediately upon completion of the cancellation process. You will be able to continue using the site only within the capabilities of the free service tier.

(c) Data Retention: As long as your User Account remains active (even if the subscription is set to cancel at the end of the term), your personal data associated with the account remains subject to the standard data handling practices described in the Privacy Policy.  In the case of immediate subscription cancellation, any files stored in your account under the subscription (if such files exist) will be marked for immediate deletion according to the data deletion policy (Section 5). It is clarified that in such a case, you will have no claim against JUMBOmail regarding the deletion of these files, even if they were files you sent or received and were set to be saved under your account.

(d) Data Deletion After Subscription Expiration (Non-Renewal): Upon the expiration of the last paid Subscription Term (in the case of non-renewal or cancellation where the term expires), User Content stored in your account exceeding free tier limits may be permanently deleted according to the data deletion policy (Section 5).

14.3 Refunds and Cancellation Fees

Subscription Fees are generally non-refundable. You may be entitled to a partial or full refund only as expressly required by the law in your jurisdiction, or potentially under specific promotional terms clearly stated at the time of purchase. In cases where a refund is legally mandated or offered by JUMBOmail for cancellation before the end of a Subscription Term, JUMBOmail reserves the right,  subject to applicable law, to make adjustments or deductions from the refund amount. These may include, individually or in combination:

(i) Standard cancellation processing fees (e.g., potentially up to a specified small percentage of the transaction price or a fixed amount, whichever is less, as permitted by law).

(ii) Charges reflecting costs incurred by JUMBOmail due to significant usage of premium features during the monthly term in which your cancellation notification is received. Specifically, if the total file transfer volume you initiate during this monthly term exceeds the standard free tier allowance (e.g., 2GB), a usage charge (e.g., $1.25 USD per GB, or the equivalent in the transaction currency, subject to prevailing exchange rates) may be calculated. This charge will apply to each gigabyte (1GB) of file transfer volume that is in excess of the standard free tier allowance used during that monthly term. This calculated usage charge may then be deducted from any potential refund amount due to you, up to a maximum deduction equal to the total cost of the subscription being cancelled.

(iii) If you cancel an annual subscription before the end of the year, the fee for the portion of the subscription term already used will be recalculated based on the standard  monthly subscription rate (without the annual discount) applicable at the time of cancellation. The Cancellation Fee (i) and Usage Charge (ii) described above will then be calculated based on this recalculated monthly rate basis for the relevant period. JUMBOmail may deduct the difference between the recalculated cost (plus applicable fees/charges) and the amount originally paid from any potential refund.

Any applicable deductions or adjustments will be calculated based on the specific circumstances and governing law, and will be communicated during the cancellation process where feasible.

14.4 Effect of Account Deletion

Choosing to delete your entire User Account is a separate action from cancelling a subscription. This action can be done from your account details page  https://www.jumbomail.me/en/user/profile/details.

Upon confirmation of an account deletion request: (a) Immediate & Permanent Deletion: All personal data associated with your account (including profile information, contact lists, transfer history) and any User Content stored within your account (including files saved under subscriptions) will be immediately and permanently deleted from JUMBOmail’s active systems. (b)  Irrecoverable: This data cannot be recovered after account deletion. (c) No Claim: You will have no claim or complaint against JUMBOmail regarding the permanent deletion of your data following a confirmed account deletion request.

14.5 JUMBOmail’s Right to Terminate/Suspend

JUMBOmail also reserves the right to suspend or terminate your account or access to Services for violations of these Terms.

15. Voluntary Support Payments

Users may have the option to provide voluntary financial support to JUMBOmail through designated payment methods, separate from any Subscription Service fees. For the avoidance of doubt, such payments are considered voluntary contributions to support the Service. They are entirely separate from any fees paid for accessing specific products or Subscription Services, are not provided as consideration for any specific service deliverable, and are non-refundable.

16. Sales promotions and benefits

From time to time, JUMBOmail may, at its sole discretion, offer sales promotions, benefits, or discount codes (“Promotional Offers”) for purchasing or experiencing Subscription Services. These offers may be communicated directly to users, published on the website, or made available through collaborations with third parties. Each Promotional Offer will be subject to specific terms and conditions determined by JUMBOmail, including eligibility requirements, the amount or nature of the discount/benefit, and the validity period. JUMBOmail reserves the right to modify or withdraw any Promotional Offer at any time. Benefit or discount codes must typically be applied at the time of purchase. Specific codes may be applicable only to certain subscription plans (e.g., annual vs. monthly) or tiers, as defined in the offer’s terms. Purchasing a service at a discounted price through a Promotional Offer does not guarantee the availability of the same price or offer for future renewals or subsequent purchases. Standard pricing will apply unless a valid Promotional Offer is applicable at the time of renewal or purchase. Additional details regarding current Subscription Services and pricing can typically be found on the main subscription information page on the JUMBOmail website.

17. Email Policy and System Notifications

The JUMBOmail system sends various email communications related to your use of the Service. These include:

(i) Transactional Notifications: Emails directly related to your actions or account status, such as file upload confirmations, download links sent to recipients, notifications to senders when files are downloaded, reminders before file deletion, password reset emails, payment confirmations, and important account security alerts.

(ii) Service Updates & Tips (Registered Users): Emails containing information about Service updates, new features, usage tips, or recommendations based on your activity, sent to Registered Users.

(iii) Marketing/Promotional Emails: Emails about JUMBOmail products, services, or special offers sent to users who have explicitly opted-in to receive such communications (e.g., joined a mailing list).

You may receive emails from JUMBOmail if: (i) another user sends files to your email address via the Service; (ii) you register for a User Account, purchase a Service, or interact with features requiring email communication; or (iii) you explicitly subscribe to a mailing list.

By using the Service (e.g., sending files, registering an account), you acknowledge and agree that JUMBOmail will send necessary transactional email notifications to you and, where applicable, to the recipients you designate. You consent to receive these essential operational communications.

Managing Preferences

(a) Registered Users: You can typically manage preferences for certain non-essential communications (like service updates/tips or promotional emails) through settings within your User Account management interface.

(b) Non-Registered Users/Recipients: Recipients of emails may find links within the email footer allowing them to manage preferences specifically for communications sent to that email address (e.g., opting out of future non-transactional messages).

(c) Opt-Out Consequences: Choosing to opt-out of certain communications may impact your use of the Service. For example, if you block all emails from JUMBOmail, you may not receive notifications when other users share files with you. Files shared with you are subject to standard deletion timelines regardless of whether you received or opened the notification email.

Anti-Spam Policy

JUMBOmail prohibits the use of its Service for sending spam. JUMBOmail reserves the right to block users engaging in spam activities. If you receive an unsolicited email that you suspect is spam originating from JUMBOmail, or an email misrepresenting itself as being from JUMBOmail (phishing), please forward a copy of the email with your comments to support@jumbomail.me or through the  Contact Form on the JUMBOmail website for investigation.

18. JUMBOforms service

(a) Feature Description: JUMBOmail may offer a “JUMBOforms” service, typically available to Premium and Business Subscribers. This service allows subscribers to embed a JUMBOmail file upload form directly onto their own website using provided code snippets. This enables the subscriber’s website visitors (“End Users”) to upload and send files directly to the subscriber through the embedded form, without needing to visit the main JUMBOmail website. Usage of JUMBOforms (e.g., bandwidth, storage consumed by received files) typically counts towards the subscriber’s plan allowances and is at the subscriber’s expense. Further details about the JUMBOforms service can be fond on the page https://www.jumbomail.me/en/jumbo-forms.

(b) Content Handling and Ownership: Files and associated data submitted by End Users through an embedded JUMBOform are transmitted to the subscriber’s JUMBOmail account. As stated in Section 7.1, ownership of this User Content (submitted by the End User) remains with the End User or the subscriber, as applicable based on their relationship; JUMBOmail claims no ownership rights. The subscriber can manage these incoming submissions like other received files within their account interface.

(c) Storage and Deletion: Files received via JUMBOforms are stored within the subscriber’s JUMBOmail account and are subject to the subscriber’s storage limits and data retention settings. Files may be deleted manually by the subscriber or automatically based on account settings (e.g., deletion after download or after a set period). Standard deletion timelines apply (e.g., deletion requests may take up to 24 hours; immediate deletion options may be available). Once deleted, files are generally irrecoverable.

(d) Subscriber Responsibility (Storage Limits): It is the subscriber’s sole responsibility to monitor their account’s storage usage and ensure sufficient space is available to receive files via JUMBOforms. If the subscriber’s account storage is full, attempts by End Users to submit files through the embedded form may fail. JUMBOmail may attempt to notify the subscriber of such failures but is not liable if notifications are not received or acted upon.

(e) Disclaimer of Liability: JUMBOmail is not responsible for any damage, loss of income, or other harm resulting from failures or malfunctions in the JUMBOforms service, including failures in receiving files due to storage limits or other technical issues. Use of the JUMBOforms service is at the subscriber’s own risk, subject to our terms of use.

(f) Client Listing: JUMBOmail reserves the right to identify subscribers using the JUMBOforms service by displaying their company name or website logo in promotional materials or client lists, unless otherwise agreed in writing between the subscriber and JUMBOmail.

19. Content Sharing Implications

(a) Recipient Access: When you use the Service to send or share User Content with another person (a “Recipient”), you grant that Recipient permission to access, view, and download the shared User Content via the provided access link or other sharing mechanism.

(b) Recipient Actions: Be aware that Recipients who download your User Content may subsequently save copies, modify, or further distribute that content independently of the JUMBOmail Service. Once a Recipient has downloaded the content, you may no longer have control over its subsequent use or distribution by that Recipient.

(c) Recipient Account Storage: If a Recipient is also a JUMBOmail user, they may have the option to save a copy of the shared User Content directly to their own JUMBOmail account (subject to their account limits and terms).

(d) Effect of Sender Deletion: If you delete shared User Content from your own account or if it is automatically deleted per retention policies, this action removes the content from your account records and may disable the original access link. However, it does not automatically delete copies that Recipients may have already downloaded or saved to their own devices or JUMBOmail accounts. Such copies will remain accessible to those Recipients.

20. Information Security and Privacy

(a) Service Dependencies and Availability: You acknowledge that the Service operates over the Internet and relies on various third-party factors (infrastructure, networks, servers). These systems are subject to potential failures, malfunctions, or interruptions. You agree to release JUMBOmail from liability for any inability to access or use the Service, partially or fully, due to such external factors or technical issues impairing service availability.

(b) Security Measures and Risks: JUMBOmail implements reasonable security measures designed to protect user information and maintain the privacy of data entered into the Service. However, you acknowledge that communication networks and websites are inherently exposed to security risks, including unauthorized access, hacking attempts, and data breaches. JUMBOmail does not guarantee that the Service or its servers will be absolutely immune from such unauthorized access or security incidents.

(c) JUMBOmail Trust Center: For additional information regarding JUMBOmail’s security practices, compliance certifications, and data protection efforts, please visit the  JUMBOmail Trust Center at: https://trust.jumbomail.me/

(d) Disclaimer of Liability for Breaches: By using the Service, you acknowledge these inherent risks and agree to release JUMBOmail from responsibility for any damages caused to you or others resulting from security breaches, hacking, or unauthorized access to information stored within the Service. You waive any claims against JUMBOmail in connection with such incidents.

(e) Privacy Policy and Data Use: JUMBOmail is committed to protecting user privacy. Our collection, use, and disclosure of personal information are governed by the  JUMBOmail Privacy Policy, which is incorporated by reference into these Terms of Service. Key commitments include: (i)  Third-Party Disclosure: JUMBOmail generally undertakes not to transfer Registered User details to third parties for their independent commercial use, except as necessary to provide the Service (e.g., payment processors) or as permitted/required by law and described in the Privacy Policy. (ii) Permitted Uses: JUMBOmail will use user information only for legitimate purposes related to providing, maintaining, and improving the Service, enforcing these Terms, and as described in the Privacy Policy and permitted by applicable law. This may include internal uses like linking contact details provided at different times (e.g., identifying an email address via a phone number provided by the same user) for account management and security. (iii) Security Efforts: While JUMBOmail takes reasonable steps to secure user data, we are not liable for damages resulting from successful hacking or attacks on our systems, despite our security efforts.

Reference to Privacy Policy: For comprehensive details on our data handling practices, please refer to the full JUMBOmail Privacy Policy. Your use of the Service constitutes your agreement to the terms of the Privacy Policy (https://www.jumbomail.me/en/privacy-policy).

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by JUMBOmail. These links are provided for your convenience only. You acknowledge and agree that: (a) JUMBOmail is not responsible or liable for the availability, accuracy, content, products, or services of such third-party resources. (b) The inclusion of any link does not imply endorsement, approval, or control by JUMBOmail of the linked resource or its operator. (c) You assume sole responsibility for and assume all risk arising from your use of any third-party websites, services, or resources. We encourage you to review the terms and privacy policies of any third-party resources you interact with.

22. Intellectual Property Restrictions (JUMBOmail Service)

This section pertains specifically to JUMBOmail’s intellectual property rights in the Service itself, distinct from User Content rights covered in Section 7.

(a) Ownership: The JUMBOmail website, including its underlying software, planning, structure, design, text, graphics, logos, and overall appearance (“JUMBOmail Platform IP”), is the exclusive property of JUMBOmail and its licensors, protected by copyright, trademark, and other intellectual property laws.

(b) User Restrictions: You have no right, title, or interest in the JUMBOmail Platform IP, except for the limited right to access and use the Service as permitted by these Terms. You agree not to (and not to permit or authorize any third party to): (i) Copy, transfer, adapt, modify, distribute, reproduce, sell, lease, sublicense, or create derivative works of the JUMBOmail Platform IP or any part thereof. (ii) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying ideas, algorithms, structure, or organization of the Service or any JUMBOmail Platform IP. (iii) Remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Service. (iv) Use the Service in any manner that could damage, disable, overburden, impair, or interfere with the Service, its security, or the ability of other users to access or use the Service.

23. Automatic Translation Disclaimer

Portions of the JUMBOmail website and Service interface may be translated into languages other than English for user convenience, potentially utilizing automated translation software (e.g., Google Translate). While reasonable efforts are made to provide accurate translations, automated translation tools are not perfect and may contain errors or inaccuracies in wording or meaning. Translations are provided “AS IS” without warranty of any kind, express or implied, regarding their accuracy, reliability, or correctness. Certain content types (e.g., images, videos) may not be translated due to software limitations.

The English version of the JUMBOmail website and these Terms of Service constitute the official and controlling text. Any discrepancies or differences created in translations are not binding and have no legal effect for compliance, enforcement, or any other purpose. If any questions arise concerning the accuracy of information presented in a translated version, users should refer to the official English version.

24. Disclaimer of Warranties

The JUMBOmail Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranty of any kind, either express or implied. Without limiting the foregoing, JUMBOmail explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement.

JUMBOmail makes no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. JUMBOmail makes no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content obtained through the Service.

Your use of the Service is at your own risk. You acknowledge and agree that JUMBOmail is not responsible for any damage to your computer system, mobile device, or data (including loss of data) that results from your use of the Service or the download or use of any files or content therefrom. This includes, but is not limited to, damage resulting from viruses, malware, or other harmful components that may be present in files transferred via the Service.

Note: For enterprise customers utilizing a JUMBOmail White Label solution, specific service levels, warranties, or support terms may be governed by a separate written agreement, which would supersede conflicting provisions in this general disclaimer where applicable.

25. Indemnification and liability

(a) User Responsibility for Content and Backup: You acknowledge your sole responsibility for the User Content you upload, store, share, or download using the Service (as detailed in Section 7.1(c) and 7.1(d)) and for maintaining independent backups of your data. (b) Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event shall JUMBOmail, its affiliates, officers, employees, agents, suppliers, or licensors be liable for indirect direct or any, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, damages for loss of profits, revenue, goodwill, use, data, or other intangible losses (even if JUMBOmail has been advised of the possibility of such damages), however caused and on any theory of liability (including contract, tort, negligence, strict liability, or otherwise), arising out of or relating to: (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) unauthorized access, use, or alteration of your transmissions or content; or (v) any other matter relating to the Service.

(c) Liability Cap: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JUMBOmail’s total aggregate liability arising out of or relating to these Terms or the Service, regardless of the form of action, shall in no event exceed the greater of (I) the total amount of fees, if any, paid by you to JUMBOmail for the specific Service(s) giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the liability.

(d) User Indemnification: You agree to defend, indemnify, and hold harmless JUMBOmail, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable attorney’s fees) arising from: (i) Your use of and access to the Service; (ii) Your violation of any term of these Terms of Service; (iii) Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) Any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Service.

(e) Exclusions: Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. Nothing in these Terms affects any statutory rights that cannot be excluded or limited under applicable law.

(a) Right to Modify Services: JUMBOmail reserves the right, at its sole discretion, to modify, enhance, restrict, suspend, discontinue, or terminate any aspect of the Services, temporarily or permanently, including features, functionalities, or availability (for free or paid tiers), at any time with or without prior notice. JUMBOmail does not guarantee that the website or any specific Service will remain operational indefinitely. This includes the right to cancel free usage accounts or alter the terms of free service access.

(b) Right to Modify Terms: JUMBOmail also reserves the right to modify these Terms of Service (including the incorporated Privacy Policy and Cookie Policy) at any time. (i)  Notification: If we make material changes to these Terms, we will provide notice through the Service interface, by posting the revised Terms on the website (updating the “Last updated date” at the top), or by sending an email notification to the address associated with your User Account, or through other reasonable means, typically before the changes become effective. Non-material changes may be made without direct notification besides updating the posted Terms. (ii) Review: It is your responsibility to review the Terms of Service periodically for any changes. (iii) Acceptance: Your continued access to or use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and, if applicable, cancel your subscription or delete your account as described in Section 14.4.

(c) Consequences of Violation or Termination: JUMBOmail may restrict access to or delete User Content, or suspend/terminate accounts for violations of these Terms or if JUMBOmail decides to terminate the Service.
